Home Office consultation on strengthening and simplifying the civil penalty scheme to prevent illegal working

I am writing to you advise you about a consultation that the Home Office has published today on measures to reform the civil penalty scheme to prevent illegal working.

This consultation follows the announcement by the Prime Minister in his immigration speech on 25 March that the Government intends to take tougher action against employers of illegal migrant workers, and double the maximum civil penalty against them.

The consultation seeks views on our proposals to strengthen and simplify the current civil penalty scheme to prevent illegal migrant working.

Employers already have a responsibility to check that their employees have the right to work in the UK, and, since 2008, this has been underpinned by a civil penalty scheme. This has been successful in requiring employers to make right to work checks and imposing a sanction on those who do not. We propose to further refine these requirements to get tougher on employers who continue to exploit illegal migrant workers, and increase the sanction to reflect the harm they cause. In parallel, and mindful of the burdens on legitimate businesses, we propose a number of measures to significantly reduce the administrative costs of complying with the requirements to make checks.

The consultation that launched today will inform the development of proposals for the Immigration Bill and future secondary legislation, and we would welcome your views. It follows proposals that were launched on 3 July to regulate migrant access to health services and to prevent access by illegal migrants to privately rented accommodation.

The consultation document and online questionnaire are available on the Home Office website.

If you have any questions about the consultation, please contact us at the following email addresses;

Consultation papers on wider Home Office issues are also available from the Gov.uk website.
